Please read on to learn the rules and restrictions that govern your use of our website(s), products, services and applications (the “Services”), including, without limitation, any request to receive information about, or to purchase any of the products made available through our website(s) (each, a “Product”). Your purchase of any Products will also be governed by any other terms made available by us to you during the sales process.
These Terms of Use (the “Terms”) are a binding contract between you and Damikan, INC. (“Damikan,” “we” and “us”). Your use of the Services in any way means that you agree to all of these Terms, and these Terms will remain in effect while you use the Services. These Terms include the provisions in this document as well as those in the Privacy Policy, and any other accompanying terms and conditions of sale entered into between you and us for the sale of any Products. Your use of or participation in certain Services may also be subject to additional policies, rules and/or conditions (“Additional Terms”), which are incorporated herein by reference, and you understand and agree that by using or participating in any such Services, you agree to also comply with these Additional Terms.
Please read these Terms carefully. They cover important information about Services provided to you. These Terms include information about future changes to these Terms, limitations of liability, a class action waiver and resolution of disputes by arbitration instead of in court. PLEASE NOTE THAT YOUR USE OF AND ACCESS TO OUR SERVICES ARE SUBJECT TO THE FOLLOWING TERMS; IF YOU DO NOT AGREE TO ALL OF THE FOLLOWING, YOU MAY NOT USE OR ACCESS THE SERVICES IN ANY MANNER.
ARBITRATION NOTICE AND CLASS ACTION WAIVER: EXCEPT FOR CERTAIN TYPES OF DISPUTES DESCRIBED IN THE ARBITRATION AGREEMENT SECTION BELOW, YOU AGREE THAT DISPUTES BETWEEN YOU AND US WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
Will these Terms ever change?
We are constantly trying to improve our Products and Services, so these Terms may need to change along with our Products and Services. We reserve the right to change the Terms at any time, but if we do, we will place a notice on our site located at www,damikan.com send you an email, and/or notify you by some other means.
If you don’t agree with the new Terms, you are free to reject them; unfortunately, that means you will no longer be able to use the Services. If you use the Services in any way after a change to the Terms is effective, that means you agree to all of the changes.
Except for changes by us as described here, no other amendment or modification of these Terms will be effective unless in writing and signed by both you and us
30-Days Free Returns
Your satisfaction is essential to us. If the product doesn’t meet your expectations or you change your mind, you can return your device for free. Please get in touch with our customer service team within 30 days after the delivery date to receive your prepaid return label. We cannot consider refund claims outside this timeframe.
For pre-owned devices, you can return your undamaged device within 30 days after delivery for a full refund. To be eligible for a return, your item must be sent back in the same condition it was purchased, be free of any passcodes and iCloud/Google accounts as well as any software lock (iCloud/passcode/SIM Lock. etc.) and include all accessories it came with. If the inspection finds obvious signs of use or the device was damaged after the delivery, no refunds will be granted and we’ll send the device back to you.
For Brand New devices, you can return your unopened & undamaged device within 30 days after delivery for a full refund. Please note that we only accept unopened and sealed devices in the original packaging. If the device was opened or damaged after receipt, no refunds will be granted and we’ll send the device back to you.
If the device arrives damaged, you must report the issue as soon as possible, within a maximum of 4 business days following delivery, for us to consider the claim. Please provide images of the item and the packaging so we can determine how to avoid this in the future.
Up to 12 Months Warranty
Unlike most electronics and secondhand stores, Damikan is fully confident in the devices we offer for sale - that's why every device comes with a free warranty. Depending on the device type, the warranty is provided either by the manufacturer or by our vendors with the same terms as the manufacturer’s warranty. In case of any defects observed during the warranty period, your device will be repaired or replaced (in case it’s non-repairable), for free. If the manufacturer or vendor cannot replace or repair the device, we will provide you with a gift card or store credits equal to the device value.
However, please note that if physical damage is observed, the warranty may be voided. In such cases, Damikan can offer a repair service, but the associated costs will be borne by the customer.
